Regional magistrate Hosea Mujaya had no kind words for prosecutors handling Postal and Telecommunications Regulatory Authority of Zimbabwe (POTRAZ) boss Gift Machengete’s case saying they are crippling court proceedings.
Magistrate Mujaya said the state is showing no care and delaying the matter as well as being not in order in the POTRAZ director general’s case.
Machengete had his reporting conditions cancelled and his passport released after he had submitted that he wants to go to Switzerland.
Machengete had filed his application of exception but the state was turning a deaf ear to give in its response.
The ruling was supposed to be passed yesterday but however failed because of the state’s delaying tactics.
“The state should stop treating this court like it is a chief Chinamhora court.
“We can not have the defense looking for the state every time we want to seat, this should stop,” said magistrate Mujaya.
Mujaya was giving a warning to the state, Tabani Mpofu from the President Emerson Mnangagwa special prosecuting unit who, from the beginning of this matter was always in no show.
Prosecutor Mpofu has since from the begging of the matter always failed to appear saying he is suffering from a cold.
The POTRAZ boss, Machengete is accused of violating the Public Procurement Act and the Disposal of Public Assets Regulations prejudicing the state of over $1 million.
Harare magistrate Hosea Mujaya allowed him to travel abroad before ordering him to return the passport on April 17.
