Former Foreign affairs minister, Walter Mzembi is in serious condition and unable to stand trial, his lawyer Job Sikhala told the Harare Magistrates Court today.
Mzembi who is receiving treatment in neighboring South Africa is battling colon cancer and his lawyer said the condition needs prayers.
“My client is unwilling-fully in default my Lord. He is seriously ill and the condition needs prayers.
“I myself flew to South Africa during the weekend and from an eye witness’ statement he can not fit to stand trial,” said Mr Sikhala.
Mzembi is jointly charged of criminal abuse of office and theft of trust property worth $1.6 million.
The state, represented by Brian Vito is now considering a separation of dockets for the purpose of proceedings.
The matter was rolled over to 4 February for a ruling on the separation of dockets.
