A Harare man appeared in court today on allegations of raping a 16 year old as defined in section 65 of the criminal law codification and reform act chapter 9.23.
James Mudzingwa, 22 who resides in Waterfalls was facing rape charges when he appeared before Harare magistrate Adonia Masawi.
The court heard that on the 6th of June 2016, Mudzingwa unlawfully entered into the complainant’s room (name withheld) and forced her into to indulge into a sexual activity.
The complainant told the court that Mudzingwa raped her while covering her mouth with his hands.
The girl later told her sister about the incident leading to Mudzingwa’s arrest .
The accused denied charges laid upon him saying that he was in a relationship with the complainant.
However, Harare magistrate Adonia Masawi responded to the accused’s defence saying that the matter in concern is not about the relationship status but the fact that the two indulged in a sexual activity without the consent of the complainant.
Magistrate Masawi adjourned the case to 17 June 2016 for final judgement.
