Mahiya remanded in custody again 

Zimbabwe National Liberation War Veterans’ Association secretary for information and publicity, Douglas Mahiya was again remanded in custody to Monday for bail application.

Mahiya (61) is being charged of undermining the authority of the president.

The State alleged that Mahiya created the communiqué with the knowledge and realisation that its contents might engender feelings of hostility or cause hatred, contempt or ridicule towards Mugabe.

Harare Magistrate Vakai Chikwekwe postponed  the case to Monday 1 August saying that he has to go through all the applications submitted by the state and the accused person’s lawyer.

The state denied Mahiya bail arguing that once granted bail the accused person’s sympathizers , will fuel violence.

However, Mr Nkomo objected to the state’s submissions arguing that the accused person must not suffer from what his group or followers will intend to do. He said judgement should be based on an individual not a group.

He also argued that the accused person is a bail candidate because section 50 (1) of the constitution deals with the fundamental rights of an accused person, which says that, any accused person must be released unconditionally.
