Just In: Thokozani Khupe Loses Con Court Challenge

Movement for Democratic Change (MDC-T) leader Thokozani Khupe has lost to MDC Alliance President Nelson Chamisa in a case in which she was appealing against a decision to expel her from the party in February 2018.

Khupe booted out of parliament following a request by the MDC which argued that she no-longer served the interest of the movement.

The Con Court bench led by Justice Luke Malaba trashed Khupe application without giving reasons.

Khupe’s lawyer Lovemere Madhuku said his client was considering suing parliament for damages if she can prove that she was unconstitutionally expelled.

Khupe told the full Constitutional Court bench that the Chamisa-led MDC party violated its own constitution by recalling her, and as such Parliament ought not to have expelled her in the manner it did.

Khupe was recalled by the Chamisa-led MDC following the death of founding president, Morgan Tsvangirai in February last year.

She now leads her own splinter group MDC-T and participated in the July 2018 elections separate from the MDC Alliance.
