High Court Sets Date For ED Legitimacy Challenge

The High Court will on the 21st of September 2022 hear Zanu PF Youth leader Sybeth Musengezi’s challenge against President Emmerson Mnangagwa’s legitimacy.

Musengezi who is being represented by Mbizo, Muchadehama and Makoni Legal Practitioners filed a High Court application challenging the constitutionality of a 2017 central committee meeting that resulted in the late President Robert Mugabe stepping down, and Mnangagwa taking over.

In his arguments, Musengezi claims that Mnangagwa got the post of Zanu PF first secretary without following proper procedures and therefore his elevation to that position was unconstitutional.

He has previously expressed frustration that the High Court was delaying to hear his case citing political interference by the ruling party.

However he has confirmed that they agreed to have the matter heard before High Court Judge President Justice Mary Dube on 21 September when they met at the High Court on Monday.

Our lawyers went to the High Court last week Friday for a meeting and we were also invited together with our lawyers on Monday, that is when we were given the 21st of September 2022 date” said Musengezi in an interview with 263Chat.

On Twitter, Musengezi said his urgent chamber application seeking to stop the Zanu PF congress set for October is the reason why there is movement on his legitimacy challenge.

“Thanks to this urgent chamber application that sought stop the ZANU PF congress pending finalization of the legitimacy matter. Now our Mnangagwa legitimacy matter is set down for the 21st of September for hearing before HC Judge President Justice Mary Dube. We pray for justice,” said Musengezi.

Zanu PF has said Mnangagwa enjoys presidential immunity. The ruling party has also said Musengezi cannot challenge Mnangagwa’s legitimacy since he was a ‘bogus’ party member.

Mnangagwa’s lawyers have also been pressing Musengezi to drop the High Court case with some Zanu PF activists promising to take unspecified action on him.
