In a significant move towards bolstering child protection, the Parliament of Zimbabwe has successfully passed the Children’s, Amendment Bill.
The primary objective of this legislation is to align the Children’s Act with the country’s Constitution and international conventions, ultimately strengthening safeguards for children.
The Bill encompasses substantial changes to the Act’s definitions, with a pivotal amendment being the removal of the distinction between children and young persons. Under the proposed revisions, all individuals below the age of 18 will be universally recognized as children. Furthermore, the classification of a “child in need of care” will be expanded to encompass those at risk of unlawful marriage or forced pledging expectant mothers, and unaccompanied minors. Moreover, the definition of a “parent” will be broadened to include biological parents, regardless of marital status.
One of the key provisions of the Bill is the establishment of the Child Protection and Welfare Council, endowed with additional responsibilities aimed at safeguarding vulnerable children and promoting their rights. This includes the formulation of a comprehensive national action plan every five years to ensure the protection of vulnerable children. Importantly, the Council will actively seek the opinions of children and strive to ensure their full participation in matters affecting them.
To address the grave issue of child abuse, the Bill introduces new criminal offences. Among these is the criminalization of involving children in activities related to child sexual abuse material, as well as the prohibition of denying necessary medical treatment to a child. Furthermore, the legislation imposes a duty on professionals who interact with children in their respective capacities to report any instances of suspected or anticipated child abuse.
The Bill also imposes more stringent requirements for the registration of institutions providing care for children. Additionally, it introduces Early Intervention and Family Preservation Programs that aim to preserve family structures, enhance parenting skills, rehabilitate children, and prevent instances of neglect or abuse.
The passing of the Children’s Amendment Bill marks a crucial milestone in Zimbabwe’s commitment to upholding the rights and well-being of children. By aligning legislation with constitutional provisions and international standards, the government is taking decisive action to ensure a safer and more secure environment for the country’s youngest and most vulnerable citizens.
