Chamisa Court Application Hearing Date Set

The Constitutional Court will on the 22nd of August hear the MDC Alliance leader Nelson Chamisa’s application challenging the July 30 Presidential election results which saw Zanu PF leader Emmerson Mnangagwa being declared the winner after garnering 50.8 percent to the latter’s 44.3.

Chamisa filed his Constitutional Court application seeking to set aside the outcome of the July 30 Presidential election results announced by the Zimbabwe Electoral Commission (ZEC).

The MDC Alliance presidential candidate accused ZEC of rigging elections in favor of Zanu PF leader, President Emmerson Mnangagwa who was declared winner.

Chamisa’s spokesperson, Dr Nkululeko Sibanda confirmed the development expressing confidence in the application saying it is backed by overwhelming evidence.

“President Nelson Chamisa’s court application to be heard on the 22nd of August 2018 at 10:00am. The evidence is overwhelming and victory is certain. Numbers don’t lie, so the President-Elect Nelson Chamisa looks forward to this day,” Sibanda said.

According to Chamisa’s court application, ZEC’s conduct in the just ended election was littered with irregularities that he said showed deflation of his votes while Mnangagwa’s numbers were inflated.

Zanu PF has also filed its own papers dismissing Chamisa’s application on technical basis saying it was filed after the seven day deadline had lapsed, but National Constitutional Assembly leader and constitutional lawyer, Professor Lovemore Madhuku argued that it is within the reach for Mnangagwa’s legal team to pursue the technical aspect of the case at the hearing.

“When they say that they want the case dismissed on technicality that is what they will raise at the hearing, when a matter is dismissed on technical, it is dismissed at a hearing,” said Madhuku adding that no case will be dismissed without a hearing.

Meanwhile, Build Zimbabwe Alliance leader, Dr Noah Manyika has also filed his response fighting in Chamisa’s corner as he appeared to validate most of the issues raised in the MDC Alliance petition.
