Magaya rape case postponed…bail conditions relaxed

The case of  Prophetic Healing and Deliverance, (PHD) Ministries founder Walter Magaya was today postponed  to 28 September 2016 after the state cited that docket was still at the prosecutor General’s office, with investigations still going on.

Magaya is facing charges of rape, following allegations that he raped one of his church members.

In his submissions Magaya’s Lawyer, Admire Rubaya alluded that there is no certainty that the docket will be ready soon. He thus asked for the reporting conditions to be relaxed.

While pleading for the lay back of bail conditions, Rubaya said that Magaya is a businessperson  who manages numerous  projects across the country, hence reporting thrice a week will be a major blow to his businesses.

Rubaya also asked for Magaya’s travelling documents saying that he (Magaya) will need to travel out of the country.

The state, however did not oppose to the lawyers submissions.

In his ruling Harare Magistrate Vakai Chikwekwe relaxed Magaya’s bail conditions. The new conditions will see the accused reporting at the CID (law and order) once a week.

Magistrate Chikwekwe considered that Magaya was  loyal to the initial  conditions set by the court.

The court also ruled out that Magaya was a flight risk.
